These Terms of Use and the General Terms and Conditions (“Terms”) constitute a valid and legal contract between you (“Partner”, “Driver”, “User”, “you” or “your”) and Nuhvin Global Services Pvt. Ltd. (“Company”, “Women Rider”, “WoR”, “we”, “us” or “our”).

Acceptance of Terms

When providing The Services which include registering as a Partner, accessing the App, or providing transportation services via the Platform, you:

  • Confirm that you have read and accepted these Terms.
  • Agree to the Privacy Policy, Partner Code of Conduct, and other policies issued from time to time.

Should you not accept these Terms or one of its Portions, you will not be able to register as a Partner or use the Platform to access Services.

Fundamental Partner Terms

These terms are designed to ensure a safe, professional, and transparent relationship between you (the Partner) and Nuhvin Global Services Pvt. Ltd. (“Company”). By registering and using the WOR - Women Rider platform to provide transportation services, you agree to the following:

1. Age Requirement

To register and create an account on our platform, as well as to offer your services, you confirm that you are at least 18 years old.

2. No Legal Barriers

You confirm that there are no legal, regulatory, or judicial restrictions preventing you from accessing our platform or offering your services. This includes having the lawful capacity to enter into service agreements and transactions facilitated through the platform.

3. Compliance with Rules and Laws

You agree to provide your services strictly in line with these Terms and Conditions and in accordance with all applicable laws, rules, and regulations.

4. Consent for Information Verification

By using the platform and offering services, you grant permission to Nuhvin Global Services Pvt. Ltd. to collect, verify, and confirm your personal details as needed. This may include identity verification, police clearance, background checks, or any other measures as outlined in our Privacy Policy. We encourage you to review the Privacy Policy for full details on how your personal information is managed.

5. Providing Accurate Information:

You agree to provide honest, accurate, and up-to-date information when creating your account and while offering your services. This includes personal information, contact details, and bank account information. You are solely responsible for ensuring the accuracy of this information and for correcting any errors. Please note that while we value the integrity of your data, the Company is not responsible for verifying the correctness of the information you provide.

6. Legal Commitment

By accessing our platform and offering your services, you agree that these Terms and Conditions are legally binding on you. You understand and accept that you are fully responsible for complying with these terms.

The Service

WOR – Women Rider is a technology-based platform operated by Nuhvin Global Services Pvt. Ltd. ("Company"). The platform, accessible via the Women Rider mobile application (the “App”), enables users to book transportation services offered by independent women drivers registered with the platform (“Partners”).

Unless otherwise agreed upon in a separate, written agreement, all services made available through the App are intended strictly for personal, non-commercial use, whether you are a user or a Partner.

You acknowledge and agree that WOR – Women Rider is not a transportation provider or a carrier. All transportation services accessed through the platform are independently offered by registered women Partners, who are self-employed and not employees, agents, or representatives of WOR – Women Rider or Nuhvin Global Services Pvt. Ltd.

Subject to your compliance with the Terms and Conditions, WOR – Women Rider grants you a limited, non-exclusive, non-transferable, and revocable license to use the Women Rider mobile application on your personal device strictly for the purpose of providing or receiving transportation services through the platform. This includes access to any content, materials, and features made available via the app for personal, non-commercial purposes only.

All rights not expressly granted under these terms remain the exclusive property of Nuhvin Global Services Pvt. Ltd. or its licensors.

By using the platform, you agree not to remove, obscure, or modify any copyright, trademark, or proprietary notices found within the application or related services. You may not copy, reproduce, license, lease, sell, publicly display, or distribute any part of the application without prior written approval from the Company.

Decompiling, reverse engineering, or disassembling the platform is prohibited unless expressly allowed by law. You also may not mirror, frame, deep-link, or overload the platform, nor attempt unauthorized access to its systems or networks.

The Women Rider application may include third-party content, services, or advertisements not controlled by the Company. In such cases, different terms of use and privacy policies may apply. WOR – Women Rider does not endorse or take responsibility for any services or products offered by these third parties.

When using the App via platforms like Apple iOS, Android, or Microsoft Windows, you may also be subject to the terms and conditions of those respective platform providers. These providers are not responsible for the operation or support of the Women Rider mobile application.

The application, platform, and all associated rights remain the intellectual property of Nuhvin Global Services Pvt. Ltd. or its licensors. This agreement does not transfer ownership or usage rights beyond the limited license granted herein. You may not use the WOR – Women Rider name, branding, or trademarks without written permission from the Company.

Registration, Account Responsibility, and Service Operations on Women Rider

To offer services on the Women Rider platform, you must meet the eligibility requirements and submit the necessary documents as per applicable laws and the company’s policies. You confirm that you have at least two years of driving experience. You also confirm that no case is pending against you and you have not been convicted in the last three years for any offences like drunk driving, serious criminal cases, fraud, theft, violence, or misuse of a vehicle. Before joining the platform, you must clear any pending challans related to your vehicle.

Registration, Account Responsibility, and Service Operations on Women Rider

To offer services on the Women Rider platform, you must meet the eligibility requirements and submit the necessary documents as per applicable laws and the company’s policies. You confirm that you have at least two years of driving experience. You also confirm that no case is pending against you and you have not been convicted in the last three years for any offences like drunk driving, serious criminal cases, fraud, theft, violence, or misuse of a vehicle. Before joining the platform, you must clear any pending challans related to your vehicle.

You need to register and create an account on the Women Rider platform by providing correct and complete information. We may request documents or details to verify your identity directly or through third-party services. If we are unable to verify this information, we may suspend, limit, or stop your access to the platform.

You are responsible for keeping your account username, password, and other login details safe. Women Rider will not be responsible for any loss caused by someone else using your account. You are fully responsible for all activities that happen through your account and must take proper care to secure your login information.

If you feel your login details have been shared or misused by someone else, you must inform Women Rider immediately. The company is not responsible for any misuse of your account. Ride requests from customers will be sent to you through the platform. You are not allowed to accept rides directly from the street or through any other way while using the platform.

The company can introduce, remove, or change types of services and request options as needed. If you are delivering any parcels as part of the services, you must not open, damage, or tamper with them without permission. The company may record calls made between you and customers for training, safety, and service improvement purposes. By joining, you agree to this.

You must always use the correct and updated version of the Women Rider mobile application. The company is not responsible if you use the wrong or outdated version. You also agree that Women Rider or its representatives may contact you through calls, WhatsApp, SMS, email, or notifications for matters related to the platform and services.

Partner Code of Conduct — Women Rider

  • Accept Service Requests: Do not reject customer ride requests unless absolutely necessary. Frequent refusals may lead to suspension or account termination.
  • Professional Behaviour: Avoid any action that could harm the reputation of Women Rider. Follow all applicable laws while using the platform.
  • Account Usage: Do not share or transfer your account or vehicle to anyone else. Only you are authorized to use your registered account and vehicle.
  • Safe and Lawful Use: Do not use the platform for illegal, harmful, or disruptive activities. Never operate under the influence of alcohol, drugs, or illegal substances. A zero-tolerance policy is in place for such behavior.
  • Respect Platform Rules:
    • Do not damage, misuse, or overload the app or platform systems.
    • Do not copy, share, or distribute platform content without permission.
    • Only use the platform on authorized, compatible devices.
  • Content Restrictions: Do not upload, share, or display content that is offensive, illegal, misleading, harmful, or violates the rights of others.
  • Working Hours: Partners can operate for a maximum of 12 hours per day, followed by a compulsory 10-hour break before logging in again.
  • Verification & Training:
    • You must undergo police verification and background checks.
    • Complete a mandatory 24-hour training program before onboarding.
    • Attend any additional or refresher training if required.
  • Vehicle Inspections: Women Rider may conduct random checks of your vehicle to ensure compliance with these terms and the law.

Failure to follow these guidelines may result in suspension or permanent deactivation of your account.

Payment

  • The Company has the right to charge fees to the Partner as mentioned on the platform, and these fees will include applicable taxes as per the law.
  • The Company also collects a convenience fee from the customer for providing the platform’s services and for facilitating ride bookings.
  • The Partner authorizes the Company to collect the total fare amount from the customer on their behalf, either through digital payment methods or cash.
  • If the Partner collects the fare in cash from the customer, the Company’s convenience fee and any applicable third-party charges, such as payment gateway fees, transaction charges, or other service fees, will be deducted from the Partner’s payable balance. The remaining settlement amount will be transferred to the Partner after all deductions have been made.
  • The Company reserves the right to revise the fee structure, deduction amounts, and payment terms from time to time. Any updates will be communicated to the Partner through the platform or other official means. The Partner is responsible for reviewing these updates and complying with the revised terms.
  • The Company may also adjust payments in case of any penalties, customer refunds, or deductions required under applicable laws or policies.

Disclaimer

The services provided by WOR - Women Rider are made available on an "as is" and "as available" basis. The Company makes no warranties or guarantees, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the reliability, safety, timeliness, quality, or availability of the services or any transportation services availed through our platform. WOR - Women Rider makes no commitment that the services will always be available, uninterrupted, or error-free.

The use of services is at the user’s and partner’s own risk. WOR - Women Rider does not control or guarantee the conduct, safety, suitability, or ability of any third-party providers, including drivers or riders, and disclaims all liability arising from any interactions between users and third-party service providers.

Limitation of Liability

To the maximum extent permitted by applicable law, WOR - Women Rider shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages. This includes but is not limited to loss of profits, loss of data, personal injury, property damage, or other losses arising out of or in connection with:

  • Your use or inability to use the services
  • Any transaction or relationship between you and any third-party provider arranged through the platform
  • Any delay, failure, or performance issues beyond our reasonable control.

WOR - Women Rider is not responsible for the actions, errors, omissions, representations, warranties, breaches, or negligence of any third-party service providers or for any personal injuries, death, property damage, or other damages or expenses resulting from these.

Indemnity

You agree to protect and not hold WOR - Women Rider, its directors, officers, employees, and agents responsible for any claims, losses, damages, expenses, or legal costs that happen because of:

  • Your use of the services or any services you get through the platform.
  • Your breaking of any terms, conditions, or laws.
  • Any wrong actions, mistakes, or carelessness by you.
  • The way WOR - Women Rider uses the information or content you provide.
  • Any harm or issues you cause to third parties, including drivers, passengers, or other users.

Lost Belongings Policy

As a partner (driver) with WOR - Women Rider, you are expected to check your vehicle after every trip to see if the customer has left any personal belongings behind.

If you find any lost property:

  • You must safely keep the item and either return it directly to the customer or hand it over to the WOR - Women Rider office as soon as possible.
  • Do not misuse, withhold, or dispose of any found items.

Please note:

  • WOR - Women Rider is not responsible for any loss, theft, or damage to the customer’s property while it is in your possession or during transit.
  • If you hand over a lost item to WOR - Women Rider, we will keep it for a maximum of 3 months.
  • After this period, if the item remains unclaimed, WOR - Women Rider has the right to dispose of it, and no claims will be entertained.

We encourage you to act responsibly and help customers retrieve their lost belongings wherever possible.

Status of the Partner

The Partner shall operate as an independent contractor and not as an employee, agent, associate, or representative of WOR - Women Rider. The relationship between WOR - Women Rider and the Partner is strictly that of two independent entities, operating on a principal-to-principal basis.

Nothing in these Terms shall be interpreted to create any partnership, joint venture, agency, franchise, employment, or other form of legal association between WOR - Women Rider and the Partner. The Partner shall have no authority to bind, represent, or act on behalf of WOR - Women Rider in any manner.

Donation Terms

Donations made through the WOR - Women Rider platform are voluntary, non-refundable, and used for women’s empowerment and community welfare programs. Transaction charges may apply. The company reserves the right to change or discontinue the donation program at any time. Donor details will be kept confidential as per our privacy policy.

Termination Rights and Obligations

Women Rider reserves the right to terminate these Terms and Conditions ("Agreement") at any time, with immediate effect, at its sole discretion, by disabling the Partner’s registration and access to the platform, without any prior notice, in the event of any breach or violation of these Terms. Such violations include, but are not limited to:

  • Misuse of the Platform: Any unauthorized use, manipulation, or exploitation of the platform and its features.
  • Non-Compliance with Applicable Laws: Failure to adhere to any local, state, or national laws governing the provision of services, including transportation laws and safety regulations.
  • Failure to Verify or Authenticate Partner Information: If the Partner provides false, incomplete, or inaccurate information or fails to comply with any verification process as required by Women Rider.
  • Fraudulent or Illegal Activities: Engaging in fraudulent conduct, misappropriation of funds, embezzlement, or any illegal activities that violate applicable laws or harm the interests of Women Rider.
  • Customer Complaints: Continuous, unresolved customer complaints, negative reviews, or failure to meet performance expectations as set forth by Women Rider.
  • Unprofessional or Inappropriate Behavior: Any act that disrupts or damages the reputation of Women Rider, including rudeness, misbehavior, or inappropriate conduct towards customers, staff, or other partners.
  • Criminal Activity: Any involvement in a criminal offense, including but not limited to physical assault, harassment, theft, or any illegal act.
  • Substance Abuse: Operating the platform while under the influence of drugs or alcohol, which violates Women Rider’s strict zero-tolerance policy regarding the use of illegal substances and alcohol while performing services.
  • Failure to Abide by Company Standards: Non-adherence to service quality standards, operational guidelines, or any other policies and procedures set forth by Women Rider.
  • Misuse of Company Assets: Any unauthorized or improper use of assets provided by Women Rider, including vehicles, branded materials, or digital assets, that affects the platform's operations or reputation.
  • Absconding or Concealment: If the Partner fails to return or absconds with any company property, including vehicles, payment, or delivery items, or any other company asset.

In addition, Women Rider retains the right to terminate this Agreement without prior notice if the Partner is found to have failed a background check or if any part of the background check is negative during the course of the Partner’s engagement with the platform.

Termination Procedure:

  • Immediately cease accessing the platform and offering services through Women Rider.
  • Return all property, materials, and confidential information belonging to Women Rider, including any equipment, vehicles, promotional items, or documentation.
  • Settle any outstanding financial obligations, including the payment of any amounts owed to Women Rider, which may be subject to deduction for any liabilities or damages incurred during the term of the Agreement.
  • Refrain from representing themselves as a partner or associated with Women Rider in any capacity, including the use of the company’s name, brand, or trademark.

Termination by the Partner: The Partner also has the right to terminate this Agreement by providing written notice of termination to Women Rider at least seven (7) days in advance. Upon receipt of such notice, Women Rider will review the situation, and the Partner will be required to follow the same procedures outlined above for the return of property and settlement of dues.

Legal Action:

If the Partner engages in any conduct that violates the Terms and Conditions or applicable laws, Women Rider reserves the right to take legal action, including but not limited to seeking damages, filing complaints, and pursuing any other available legal remedies. The Partner acknowledges that they may be subject to legal liability and consequences arising from such violations, and Women Rider will not be held responsible for any negative outcomes resulting from such actions.

Consequences of Termination:

Termination of this Agreement shall not relieve the Partner of any liability or obligations accrued prior to the effective termination date. The Partner agrees that Women Rider shall not be liable for any damages, losses, or consequences resulting from the termination of this Agreement, including the loss of income or business relationships.

Effect of Termination:

Upon termination, all rights and licenses granted to the Partner under this Agreement shall immediately cease, and the Partner will no longer be authorized to perform services or represent Women Rider in any capacity.

Governing Law, Jurisdiction, and Dispute Resolution

  1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of India.
  2. Any disputes or legal proceedings arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Hyderabad, Telangana.
  3. In the event of any dispute, both parties shall first attempt to resolve the matter amicably through mutual discussions.
  4. If the dispute remains unresolved within 15 (fifteen) days from the date of first communication, the matter shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.
  5. The seat and venue of arbitration shall be Hyderabad, Telangana, and the proceedings shall be conducted in the English language.
  6. The decision of the sole arbitrator, appointed mutually by both parties, shall be final and binding on both parties.
